General Terms and Conditions
(The following GTC also contain legal information on your rights under the provisions on distance contracts and electronic commerce).
1. scope of application
These General Terms and Conditions (GTC) apply to all deliveries by TRI-HOP to consumers (§ 13 BGB).
A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.
2nd contract partner
The purchase contract is concluded with: TRI-HOP, Henri Friedman, Schwetzinger-Str. 97, 68165 Mannheim. You can reach our customer service for questions, complaints and objections by e-mail at info@tri-hop.de.
3. offer and conclusion of contract
3.1 The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to order. Errors excepted.
3.2 By clicking on the button [kostenpflichtig bestellen] you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order.
4. right of withdrawal
4.1 Consumers have the following right of withdrawal for goods that were not manufactured according to customer specifications.
(There is no right of withdrawal for coin rings if they were made according to customer specifications)
————————————–
Right of withdrawal
You can revoke your contractual declaration within 14 days without giving reasons in text form (e.g. letter, fax, e-mail) or – if the goods are handed over to you before the deadline – also by returning the goods. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also not before fulfillment of our information obligations under Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and our obligations under § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. The timely dispatch of the revocation or the goods is sufficient to comply with the revocation period. The revocation is to be sent to:
TRI-HOP, Henri Friedman, Schwetzinger-Str. 97, 68165 Mannheim
Consequences of revocation
In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) surrendered. If you are unable to return or surrender to us the performance received and benefits (e.g. benefits of use) or are only able to return or surrender them in part or in a deteriorated condition, you must compensate us for the value. You only have to pay compensation for the deterioration of the item and for any use made of it if the use or deterioration is due to handling of the item that goes beyond checking its properties and functionality. Testing the properties and functionality” means testing and trying out the respective goods, as is possible and customary in a retail store, for example. Goods that can be sent by parcel post are to be returned at our risk. You have to bear the regular costs of the return shipment if the delivered goods correspond to those ordered and if the price of the goods to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise the return shipment is free of charge for you. Items that cannot be sent by parcel post will be collected from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of revocation or the goods, for us with their receipt.
End of the withdrawal policy
————————————–
The right of withdrawal does not apply to distance selling contracts
– for the delivery of goods manufactured according to customer specifications.
4a. Return costs when exercising the right of withdrawal
